Standardized contract advocacy

The New Southbound Job Bank (hereinafter referred to as "the Platform") focuses on matchmaking for white-collar foreign talent in Taiwan, adopting a "recruitment agency model" where companies pay for the services, and job seekers pay nothing throughout the process . The Platform operates in accordance with the Employment Service Act and reminds all job seekers through the Platform that signing a contract is a crucial step in protecting their rights. Whether signing a referral service contract with a recruitment agency or an employment contract with a company, one should fully understand the contents of the contract before signing.

I. Three types of contracts you may sign during the job search process

Contract Type Under what circumstances would you sign? Must-read key points
Standardized contracts for job placement services Job placement through private employment service agencies (intermediaries) Services provided, obligations of both parties, termination method, and damages.
Labor Contract Establishing a formal employment relationship with the employer Wages, working hours, leave, labor and health insurance, job duties, contract period
Foreigner Employment Permit Related Documents Foreign white-collar workers employed by Taiwanese companies Applying for a work permit, obtaining an ARC (Advanced Research and Employment Assistance) certificate, and meeting legal salary thresholds.

II. Seven self-checks before signing the contract

  1. Does the identity match? Is the agent or employer legally registered? You can check with the Workforce Development Agency .
  2. Can you understand the terms and conditions? Foreign job seekers are advised to request a bilingual (Chinese and English) version to avoid a single-language version.
  3. Is the fee appropriate? There are limits on the fees that agencies can charge job seekers (according to Article 35 of the Employment Services Act), and they are prohibited from collecting deposits or security deposits.
  4. Are the working conditions specific? The job description, working hours, overtime pay calculation, and probationary period length should be clearly stated.
  5. Does salary affect visa eligibility? The minimum salary for white-collar foreign workers (generally above NT$47,000) will affect the issuance of work permits.
  6. Are the terms of termination and repatriation clear? Carefully review the penalties for early termination, airfare reimbursement, and non-compete clauses.
  7. Is the scope of the personal data authorization reasonable? The resume should only be used for this recruitment and should not be resold or stored indefinitely.

III. Matters that should be included according to law

According to the Ministry of Labor's announcement, the standardized contract for employment services should include the following information:

  • Party Information
  • Services provided by private employment service agencies, including their contents and descriptions.
